Twenty-five Democratic attorneys general have filed a lawsuit against the Trump administration over FEMA disaster aid conditions that they say unlawfully tie federal grants to voting and immigration policies. The legal action, led by California’s Rob Bonta, challenges more than $740 million in combined funding for disaster preparedness and counter-terrorism.

What the Lawsuit Alleges

The suit, filed in federal court in Rhode Island, argues that the Department of Homeland Security and FEMA are imposing stipulations that amount to a “campaign of coercion.” These conditions require states to use a federal system to verify voter citizenship and conduct post-election audits. Additionally, the government is attempting to withhold funds from states that refuse to assist Immigration and Customs Enforcement (ICE) with raids and deportations—a mandate already struck down by a federal court last year.

“President Trump has little support for both his mass deportation agenda and his baseless claims of election fraud, so instead, he’s trying to bully state and local governments into adopting his preferred policies in exchange for much-needed funding,” Bonta said in a statement.

FEMA’s Response

A FEMA spokesperson dismissed the lawsuit as “partisan pushback” from “leftwing politicians.” The spokesperson added: “Election security is national security, and protecting our critical infrastructure remains a top priority for the Trump Administration. These new requirements will preserve election integrity.”

Comparison of Key Grant Conditions

Condition Impact on States
Mandate to use federal voter citizenship verification system Requires state election offices to adopt new databases and processes
Post-election audit requirements Adds administrative burden and timeline pressures
ICE assistance for raids and deportations Forces state cooperation with federal immigration enforcement
FEMA ability to cancel grants if priorities misalign Uncertainty in long-term disaster planning

Previous Challenges and Legal History

Bonta and other Democratic attorneys general have previously filed two successful challenges over the same grant programs. In a ruling affirming the second of those challenges, a federal judge found that the administration’s conditions exceeded its authority. The current lawsuit seeks to block the new stipulations and restore unconditional disaster funding to the 25 plaintiff states.
